By using this website (the "Web".) or any of its services and forms, SOLTEC ENERGÍAS RENOVABLES, S.L ("Soltec".) collects the personal data of each user (the "User".) in accordance with the Legal Notice. The processing of your personal data will be governed by this privacy policy ("Privacy Policy".) or any other that may replace it in the future. Any User who does not agree with the Privacy Policy or the Legal Notice must refrain from accessing, completing any form or using the Website in any way.

INFORMATOIN COLLECTED ON THE WEBSITE
2.1. Soltec collects various information from Users, which is not always provided directly by the User accessing, registering or interacting on the Website and which differs depending on the form used (the "Personal Data".):

2.2. Also, Soltec can register the visits of the Users on the Website, the use that Users make of the Website and its links or when the User clicks on a content, interacts, or in any other way makes use of the Website.

USE OF PERSONAL DATA AND LEGAL BASIS FOR PROCESSING
Soltec, in order to enforce this privacy policy, has adopted the technical and organizational security measures that are necessary to avoid the alteration, loss, misuse, treatment and unauthorized access or theft of data of Users. Among them, Soltec has implemented an Information Security Management System that effectively complies with international standards.
3.1. Soltec uses the Personal Data of the Users provided or collected in accordance with this Privacy Policy to provide, personalize, develop and, in short, improve the provision of the services offered on the Website.
3.2. The precise way in which Soltec uses the Personal Data of the Users will depend, ultimately, on the use of the Website made by each User.

3.3.1. Selection of personnel. Based on the consent of the Users through the ticking of the corresponding box, as well as, once the selection process is advanced, the execution of the pre-contractual relations between Soltec and the job applicant, Soltec may process the Personal Data within the framework of a Soltec selection process, with the purpose of analyzing the competencies and aptitudes of the candidate, generate a profile of the same for the sole purpose of making a first screening to exclude those who fail to comply with any condition or essential requirement to be part of a selection process (such as lack of the required qualifications), and assess the candidacy of applicants for jobs that may be available to Soltec at the time of submitting the application or while such data are retained by the aforementioned entity for the same purposes. The processing of your data for these purposes also includes the processing of data concerning your health, such as your degree of disability, to the extent strictly necessary for the selection process. To this end, the User, if he/she includes this information in his/her curriculum and proceeds to send it, explicitly consents to the processing of his/her Personal Data, understanding that it is necessary for the management of his/her application and that, if he/she does not do so, we will not be able to include him/her in Soltec's selection processes. In the event that the User so accepts, Soltec may also evaluate the application for job positions in other companies of the group.

3.3.3. Other. Based on the legitimate interest of Soltec, the Personal Data of the Users may also be used for the purpose of researching and analyzing the use of the Website, to improve the services provided to the Users and to offer them greater security in relation to their Personal Data and the use of the Website. To this end, Soltec itself as well as through third parties when necessary, will conduct research, studies, statistics, surveys, usage metrics, policy improvement, study of market trends, use of data for fraud prevention, etc. As far as possible, the information used for this purpose will be aggregated at a statistical level, without identification of the User.
3.3.5 Others. WHO HAS ACCESS TO USER DATA, WHO ARE THE RECIPIENTS?
4.1. Users' personal information will only be accessible in accordance with this Privacy Policy.
4.2. Work centres. The Personal Data collected for personnel selection purposes may be transmitted to the different work centres that manage and have selection processes appropriate to their profile.
4.3. Group companies. If so requested by the User, Soltec may also transfer the Personal Data of Users who have submitted their CVs for recruitment purposes to its group companies for the purpose of assessing the User's candidacy for various job positions in the various group companies. Likewise, if the request for information or contact is related to any of the companies of the group, Soltec may also transmit the request in order to provide the requested information.
4.4. Service Providers. Soltec may use other companies to provide certain services under Soltec's guidelines. In order to provide such services (e.g., consulting, auditing, IT-maintenance, hosting server or web platform, or social media such as Facebook, Linkedin, YouTube or Twitter), such third party companies may require certain information and data from Users. Soltec guarantees that, in such cases, these third parties will have limited access to the Users' information to the extent necessary to perform the tasks entrusted to them, will sign a processing contract with Soltec, and will be obliged not to disclose the information or use it for purposes other than the provision of the relevant service.
4.5. Disclosures Required by Law. Soltec may disclose Personal Data and information provided by Users when required to do so by law, in legal proceedings, to investigate suspicious activity, or to otherwise protect its own and Users' rights. In such cases, Soltec undertakes to notify Users that their data has been legally requested, to the extent possible and in cases where such communication is not incompatible with the purpose for which the data was originally disclosed.
RETENTION OF PERSONAL DATA
5.1. Soltec retains most of the Personal Data for as long as it is necessary to fulfill the purposes stated above. After the purposes have been fulfilled, Soltec will retain the Personal Data, blocked, to the extent that liability may arise for Soltec or is otherwise legally required. As far as possible, the information will be anonymised once the User has closed his or her account. In particular:
(i) Recruitment: during the recruitment process and, after the end of the recruitment process, for a period of one year from the date on which the job application is received or from your last expression of interest in a Soltec application or from your last communication. At the end of this period, your data will be deleted.
(ii) Request for information about Solteach Pro: to the extent necessary to provide Users with the requested information and to answer the enquiry.
(iii) Solmate: We will retain personal data for as long as you are a customer of ours. In addition, we may retain them beyond that time in order to purge any liabilities arising from the processing of such personal data.
WHERE ARE PERSONAL DATA STORED?
6.1. Soltec collects, stores and processes Users' Personal Data on different servers within the European Economic Area, and also carries out international transfers of Personal Data to countries that may not guarantee the same level of data protection.
6.2. In such cases, Soltec will only carry out such international transfers of data to third countries in respect of which the Commission has issued an adequacy decision or, failing that, adequate assurances have been given by signing standard clauses or an intra-group contract. Users may request a copy of these assurances at the address indicated in this Privacy Policy. In particular, Soltec will transfer data outside the European Economic Area to the following countries:
(i) Declared suitable by the European Commission: Argentina.
(ii) Not declared as suitable by the European Commission: United States, Australia, Peru, Brazil, Chile, Colombia, India and Mexico.
REPRESENTATIONS AND WARRANTIES
7.1. The User guarantees that the Personal Data provided are true and accurate and undertakes to notify any change or modification thereof. In the event that Personal Data of third parties is provided, the User is responsible for having informed and obtained their consent to be provided for the purposes indicated in the corresponding sections of this Privacy and Cookies Policy.
7.2. Any loss or damage caused to the Website or to the person responsible for the Website or to any third party through the communication of erroneous, inaccurate or incomplete information in the registration forms shall be the sole responsibility of the User.
SECURITY OF USERS' PERSONAL DATA
8.1. Soltec is concerned about the security and protection of the Personal Data of its Users, and tries to prevent failures in this regard.
8.2. EXERCISING USERS' RIGHTS

9.1.4. Limitation of data processing. Users shall have the right to request the limitation of the processing of their Personal Data when legally established.

MINORS
10.1. In general, to the best of Soltec's knowledge and belief, Soltec will not process Personal Data of children under the age of 14.
10.2. If Soltec discovers during any of its monitoring of the Website that Personal Data of children under the age of 14 has been inadvertently collected, Soltec shall take the necessary measures that it is obliged to take as a service provider and data controller to delete such Personal Data as soon as possible. An exception to the foregoing shall be those cases in which, by reason of applicable legislation, it is necessary to retain the Personal Data of minors under 14 years of age. 10.3. In accordance with current data protection regulations, persons over 14 years of age are entitled to give their consent, except in those cases in which the regulations require the assistance of the holders of parental authority or guardianship.
